ELECTRONIC COMMERCIAL MESSAGE SYSTEM IS COMPLETELY CHANGING
It has been announced that the regulations regarding Commercial Electronic Messages, which are regulated by the Law on the Regulation of Electronic Commerce in our law, will be placed in a new regime with the regulation published in the Official Gazette on 04.01.2020. A new regulation has been introduced regarding the messages sent by companies to their customers or prospective customers. Accordingly, Commercial Electronic Messages have been connected to a system called Message Management System (IYS). Accordingly, companies that want to send commercial electronic messages are expected to register in this management system and manage commercial electronic messages on this system. Information about IYS can be obtained from www.iys.org.tr. Accordingly, it is stated that this system will be activated on 15.03.2020 and companies defined as service providers can upload their systems to this management platform. In summary, this means the following. Before this regulation change, Commercial Electronic Messages were managed by the companies themselves, but it is envisaged that they will be uploaded to a central recording system. With the installation of this system, citizens are given the opportunity to manage their own permits freely. However, companies that are not registered in the system will not be able to send messages to the end consumer. Companies are required to transfer their databases with electronic commercial message permission to IYS by 01.06.2020. They must also notify their users of this transfer. For this reason, another adaptation period has been envisaged for companies until this date.
