PURCHASING REAL ESTATE IN TURKEY: A GUIDE FOR FOREIGN PERSONS

1.Legal Base:

In May 2012, Turkish Government amended “The Code of Land Registry and Cadastrate” and made it possible for foreigners to purchase real estates without the condition of mutuality. After this amendment, citizens of the countries that are defined by the Cabinet can purchase real estates in Turkey.

If you are a citizen of a country that are listed (United Kingdom is included) as entitled to purchase a real estate, then there are some important information you should know before starting any process:

2. The Agreements should be concluded according to the legal and official procedure:

According to Turkish regulations, all the agreements regarding to the sale of a real estate must be done in the “location of real estate is at.Also it is possible and binding to sign a “Promise to Sell a Real Estate Contract” before a Public Notary in Turkey. After following the official procedure and signing the agreement, the Land Registry Office will register the real estate in the land registry on behalf of the new owner. After the completion of these steps, you will be the legal and official owner of the real estate.

3.Legal Restrictions

A. Foreigners may purchase, sell and/or use them as either residence or office. However the total area of ​​real estates that they can purchase shall not be no more than 74 Acres within the borders of Turkey

B. Before the sale of a real estate to a foreigner, Military Authorities based in the territory, must approve that the real estate is not situated in a zone of security. This approval should be concretized before any payment, as the transaction would not be possible if the real estate is in the borders of a safe zone.

4. Practical Information:

A. Documents Needed:

– National IDs and/or Passports

Residence Permit granted by the Police Department (only requested for the citizens of countries who need to have a residence permit in order to purchase a real estate)

 Original and Certified Translations of “power of attorney” and/or “power of mandate” (only for those who wants these procedures to be followed by third parties eg our firm)

B. It is always recommended to examine the documents regarding the real estate that are registered at the Land Offices. The documents should be examined in order to check if there are any hypothec or other restrictive annotations attached to the real estate that cause inconvenience to the new owners.

C. Final Notifications:

All the information received regarding the real estate by the seller, should always be cross-checked with the documents at Land Registry Office. 

– It is important to make a background research about the seller/broker/estate agency, to make sure if they are credible or not.

– It should also be noticed that all the disputes regarding the real estates in Turkey sell only be brought in the Courts and Execution Offices of Turkey which shall have jurisdiction to settle any disputes.
